1. Who you are contracting with

These Terms of Use ("Terms") are a binding agreement between you and ChannelFit ("ChannelFit", "we", "us"), the operator of this website and service.

2. Acceptance

By creating an account, purchasing a report, or otherwise using the service, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, do not use the service. You confirm that you are of legal age in your jurisdiction and, if using the service on behalf of an organisation, that you have authority to bind that organisation.

3. The service

ChannelFit provides AI-generated, pre-publish suggestions for YouTube creators. Reports are strategic guidance only and are not a guarantee of views, revenue, subscribers, rankings or any other platform performance. You are responsible for your own creative and business decisions.

4. Acceptable use

You agree not to:

• Submit content you do not have the right to share.
• Use the service to harass, deceive, defame or infringe the rights of others.
• Attempt to reverse engineer, scrape, probe, or interfere with the security or integrity of the service.
• Use the service for unlawful purposes, fraud, spam, or to distribute malware.
• Resell or redistribute the service or its outputs in a way that competes with ChannelFit.

5. AI outputs

Reports are generated by AI models and may contain errors or omissions. You are responsible for reviewing outputs before acting on them and for ensuring you have the rights to any content you submit as input. We may remove or refuse content that violates these Terms.

6. Intellectual property

ChannelFit and its licensors retain all right, title and interest in the service, including the software, documentation, branding and any underlying AI prompts and templates. We grant you a limited, non-exclusive, non-transferable right to use the service and the reports generated for you for your own internal creator/business purposes. You retain ownership of the inputs you submit and the reports we deliver to you.

7. Payments and subscriptions

Our order process is conducted by our online reseller Paddle.com Market Ltd. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Billing, payment, tax, currency conversion, cancellations and refund mechanics are governed by Paddle's Buyer Terms. Prices are shown at checkout and may include applicable taxes depending on your location.

See our Refund Policy. Refunds are handled by Paddle as Merchant of Record.

9. Suspension and termination

We may suspend or terminate your access to the service, with or without notice, if you materially breach these Terms, fail to pay amounts due, create a security or fraud risk, or repeatedly or seriously violate our policies. You may stop using the service at any time. On termination, your right to use the service ends, but provisions that by their nature should survive (including IP, disclaimers, and liability limits) will continue.

10. Disclaimers

The service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law.

11. Limitation of liability

To the fullest extent permitted by law, ChannelFit's aggregate liability arising out of or relating to the service is limited to the amounts you paid to us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential or punitive damages, including loss of profits, revenue, data, or goodwill. Nothing in these Terms excludes liability that cannot be excluded under applicable law (such as for fraud, death or personal injury caused by negligence).

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated through the service. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of the jurisdiction in which ChannelFit is established, without regard to its conflict of laws principles. Mandatory consumer protection rights in your country of residence still apply.
